Il y a un mois, avec mon épouse, nous avons pris la décision d'ouvrir un compte joint afin qu'elle puisse gérer ma retraite à sa convenance. Pour ce faire, le directeur de la banque (BP) m'a demandé les trois derniers relevés de mes comptes. Je lui ai expliqué que je prévoyais de fermer un compte CM où ma retraite était versée et que l'autre compte BNP était destiné aux virements, ainsi qu'à un compte commun BPost où se trouvaient des assurances.

Je lui ai transmis mes relevés en soulignant que mes relevés bancaires personnels sont strictement confidentiels et ne concernent que ma relation avec la banque. Il est essentiel qu'aucune autre personne n'y ait accès. Je vous remercie de votre compréhension.

Cependant, comme je l'avais anticipé, mon épouse a eu deux rendez-vous avec la conseillère bancaire, qui a davantage insisté sur la gestion de mon compte à fermer et sur les erreurs que j'avais pu commettre, plutôt que sur les projets de placement de mon épouse. De plus, elle a montré mes relevés de compte privé à mon épouse, qui n'avait jamais eu accès à ces informations, car je suis partisan de la séparation des comptes communs et privés pour préserver l’harmonie dans notre couple.

Lorsque j'ai appris cela, j'ai informé le directeur en rappelant deux points : d'une part, ce que j'avais précisé lors de l'envoi de mes relevés, à savoir que mes comptes à la BNP et au CM sont personnels ; d'autre part, la violation du secret professionnel et de la vie privée, pouvant même relever de la violation du secret des correspondances. Le secret bancaire est protégé en France par la loi n°84-46 du 24 janvier 1984, connue sous le nom de « loi bancaire ».

En réponse, le directeur m'a simplement indiqué qu'il choisissait de me radier de sa banque, sans engager de poursuites contre sa conseillère. Cela me laisse conclure que la protection du secret bancaire, bien établie par la loi, n'est tout simplement pas respectée en France.
