On Monday, the man who was shot in the stomach in August at a Stark Road property took the stand in Carroll County Superior Court in defense of the alleged shooter during a bail hearing. However, the judge ended up denying bail.
The back story to the incident is that Hamilton and Bynoe are extended family members living on property owned by his mother and stepfather, spanning about 18 acres. Bynoe had twice gone to confront Hamilton at Hamilton's so-called "tree fortress," where Hamilton "forges his soul." Hamilton refers to himself as "the trash wizard of the White Mountains," apparently because he also burns garbage at the fortress.
He said Bynoe didn't trust him due to Hamilton's history of drug use, but added that he no longer uses drugs.
According to Hamilton, Bynoe came down a path to confront him about damage he believed Hamilton had done to Bynoe's car. Hamilton described Bynoe as "upset" and said Bynoe wanted him to "grow up" and "get out of the woods."
At that point, Bynoe allegedly fired a bullet into the ground and left.
From there, according to testimony and statements from lawyers, Bynoe returned to the house a few hundred feet away, helped his mother bring in groceries, then came back to confront Hamilton a second time. Hamilton said he went on the offensive.
"I'm gonna go whup his ass," Hamilton recalled thinking at the time. "Whatever happens, I'm gonna whup his ass."
Hamilton was animated on the stand, at times using his entire body to illustrate his points.
He said he called Bynoe a "chicken" and suggested he stop living on his mother's property. Hamilton also said he told Bynoe he would drink his blood from a cup, though he added that he was "just trying to sound cool."
He later acknowledged he shouldn't have threatened to drink Bynoe's blood.
Hamilton said Bynoe warned him to stay back and not go past a certain rock on the ground. Hamilton ignored the warning, and went past the rock because he said Bynoe had a smirk on his face.
"I froggy jumped, and he pulled the trigger," Hamilton said, adding that the bullet didn’t hurt him. "I literally had lost my sense of self and was pissed off to the point of, I don't care if you have a gun, I don't care about your boundaries."
Hamilton added later that he might also have been making animal noises. "It was all emotional, but I was like a barking dog," Hamilton said.
Bynoe's mother testified that Hamilton appeared "crazed" and that Hamilton is known to carry knives.
Hamilton said he apologized to Bynoe for putting him in the position of having to shoot him. "Sorry you had to shoot me. ... I want to hug you, not fight you," Hamilton said. "You won't let me."
The case now heads to jury selection in September.

Massachusetts State Police Detectives Captain Thomas McCarthy, made a salary of $548,072 with $349,815 of overtime pay. He's an pig with a long history of misconduct, including a recent incident where he fled a traffic stop by a local police officer after the officer said he smelled like alcohol. He has collected over 4mil in compensation over his career and will get a pension based on this inflated pay.
Massachusetts has this corrupt system where officers can get assigned traffic details. These were originally meant to be for road projects that needed someone directing traffic, but most details now consist of a lazy pig sitting in a police car on the side of the road.
