Sollte das nicht eigentlich den gleichen Effekt haben? So lange man die Cookies nicht explizit akzeptiert hat, sind die doch effektiv auch abgelehnt

Ne, wenn du die Seite nutzt und dabei den Cookie Banner einfach offen lässt, kann das als implizite Zustimmung gewertet werden. Wird ja auch oft so formuliert: by continuing to use this site you agree to our data privacy rules.

Eher nicht, da eine eindeutige Zustimmung erfolgen muss. Die ist ja nicht erfolgt. Der Satz wird gerne verwendet, halte ich aber für rechtlich unwirksam
